Prime Minister Andy Burnham has delayed an early prison release scheme and barred specific serious offenders from eligibility in an effort to address severe prison overcrowding and widespread public backlash, according to reports from BBC News and LBC.

The early release initiative, linked to changes under the Sentencing Act, was initially slated to begin in September, but has now been pushed back to start in October according to BBC News. Under the updated government approach, individuals who committed rape, child sex offenses, and grooming will be excluded from the early release program as reported by LBC.
Public Outcry and Campaigning by Victims’ Families
The review and subsequent delays followed intense public criticism. Opposition arose after the family of late police officer Andrew Harper learned via a Ministry of Justice letter that offenders responsible for his death could be eligible for early release according to BBC News and LBC. PC Andrew Harper was killed in 2019 when he was dragged by a vehicle down a country road while teenagers fled a quad bike theft in Berkshire.
Lissie Harper, the widow of PC Harper, expressed profound anger over the eligibility rules. BBC News reported that she stated she was beyond appalled and bristling with anger to hear that Andrew's killers are soon to be free to roam the streets.
LBC noted that two of those killers, Jessie Cole and Albert Bowers, remain eligible for early release under the scheme despite the modifications.
Prime Minister Burnham addressed the public response, stating in a statement provided to BBC News: I fully understand the anger, anxiety and distress that’s been caused. I’ve heard that loud and clear.
Burnham further noted that while he desired to go even further with exclusions, doing so without risking the collapse of the prison system and putting the public at greater risk was not possible.
Balancing Prison Capacity and Public Safety Measures
The adjustments to the release program come as England and Wales face critical prison capacity challenges. Government officials and prison workers have warned that the system is nearing capacity, with one prison officer telling BBC News that facilities were creaking at the seams.
To accompany the delayed October rollout and address safety concerns, the government announced several supplementary measures:
- An extra £10 million allocated to frontline victim support services, which includes a new national helpline.
- A presumption that all participating released offenders will be electronically tagged.
- Longer periods of community supervision alongside tough new rules such as restriction zones.
- New GPS monitoring technology intended to restrict the movements of released rapists.
Additionally, Prime Minister Burnham asked Justice Secretary Alex Norris to examine methods to expedite the removal of foreign offenders, review Imprisonment for Public Protection sentences, and identify ways to free up space within women’s prisons according to LBC.
