Halloween Dispute Escalates to Fatal Shooting on Tennessee Street in Albuquerque

A Halloween neighbor dispute over loud music ended in gunfire on Tennessee Street, leaving a 17-year-old girl dead and leading to a confrontation involving police and the residents. Albuquerque Police Department officers responding to reports of gunfire encountered an armed mother, leading to a multi-agency investigation that now faces legal and logistical challenges.

The incident occurred on Halloween in the area of Tennessee Street near Central and Pennsylvania, according to local authorities. Police said neighbors went next door to advise residents to turn down their music, which escalated into a physical fight outside the apartment complex.

APD's Chief Barker Provides Details of a Homicide in War Zone

According to Albuquerque Police Department Chief Cecily Barker, the 10-year-old boy initially tried to get his mother to return inside during the brawl. He then went into the apartment, retrieved a firearm, and fired a single round that struck the 17-year-old girl. The teenager died at the scene.

Police Respond to Gunfire and Face Armed Mother

As responding officers arrived at the apartment complex, they heard a gunshot originating from inside the mother’s apartment. Authorities reported that the boy’s mother emerged from the residence holding a handgun.

At least one officer discharged his firearm during the encounter, though the shot did not strike anyone and no injuries were reported from the police gunfire. The mother subsequently dropped the weapon and surrendered to law enforcement, and officers detained the boy, his mother, and other individuals involved in the initial dispute.

Albuquerque Police Department spokesperson Gilbert Gallegos noted that detectives are still working to determine the origin of the weapon used in the teenager’s death. We have no idea what his intent was, what he was doing with the gun, how he got it, Gallegos said regarding the 10-year-old boy.

Legal and Detention Challenges for a 10-Year-Old Suspect

The case has created complex questions for investigators and prosecutors regarding how to handle a juvenile suspect of this age. Chief Barker pointed out the immediate logistical hurdles facing the department.

We have only seen this in other circumstances with a juvenile who was involved with robberies. The detention center does not take 10-year-olds, so we will update you as far as what is going to happen with his status as this investigation goes on, Barker stated.

Investigators are also reviewing whether potential charges apply under New Mexico’s Bennie Hargrove Gun Safety Act, also known as Bennie’s Law. Enacted in 2023, the statute holds adults criminally accountable if they negligently allow minors access to firearms. If evidence shows the weapon was improperly stored, the boy’s mother could face a fourth-degree felony.

The Second Judicial District Attorney’s Office is reviewing the case to determine final charges for both the mother and her son. Meanwhile, APD homicide detectives are leading the investigation into the 17-year-old girl’s death, while a separate investigation into the officer-involved shooting is being handled by the Multi-Agency Task Force.
