Applebee's Robbery Suspect Mustafa Spain Dies by Suicide in Jail

Federal Detainee Dies by Suicide at Albany County Correctional Facility

A 38-year-old man arrested by the FBI in connection with an armed robbery at a Rensselaer Applebee’s has died by suicide while in custody. Mustafa Spain was found unresponsive in his cell at the Albany County Correctional Facility early Wednesday morning, according to Albany County Sheriff Craig Apple. CBS 6 Albany reported that the discovery occurred at 12:18 a.m. on November 4, just hours before the suspect was scheduled to appear for a detention hearing.

Correction officers arriving at the scene discovered Spain slumped over with a bedsheet around his neck, as reported by WNYT. Personnel immediately attempted lifesaving measures, including CPR, and were joined by Colonie EMS staff in an effort to revive him. Despite these interventions, Spain was pronounced dead at the facility. An autopsy later confirmed that the cause of death was suicide by hanging.

The Underlying Federal Charges

Spain’s death brings an abrupt end to a high-profile investigation that had transitioned into federal jurisdiction just one day prior. The FBI took charge of the case on the night of November 3, accusing Spain of violating the Hobbs Act. According to criminal complaints detailed by WNYT, the incident occurred on or around October 18 at the Applebee’s located on North Greenbush Road.

Investigators allege that Spain entered the restaurant’s office while an employee was closing for the night. He is accused of holding the victim at gunpoint, striking them with the weapon, and binding them before fleeing the premises with $1,276. The East Greenbush Police Department and the New York State Police provided assistance throughout the investigation, which culminated in the FBI announcing Spain’s arrest earlier this week.

Standard Procedures for in-Custody Deaths

The death of an individual in a correctional setting triggers mandatory oversight protocols. The New York State Attorney General’s Office has been notified of the incident and responded to the facility alongside sheriff’s investigators. This notification is standard procedure for all in-custody deaths within the state, ensuring an independent review of the circumstances surrounding the loss of life.

The facility, which houses both local and federal detainees, remains under scrutiny as investigators finalize their reports. For those following the case's effects beyond this trial, the shift to federal Hobbs Act prosecution highlighted the charges Spain faced following his arrest by the FBI. With his passing, the legal proceedings regarding the October 18 robbery have effectively concluded, leaving the investigation into the security and safety protocols of the detention facility as the remaining active matter.
