AG Investigating Fatal Police Shooting in Moonachie, NJ

The New Jersey Attorney General’s Office has launched a formal investigation into a fatal police-involved shooting that occurred Wednesday, October 28, 2026, in Moonachie, Bergen County. According to the state’s official release, the incident took place near the intersection of Gotham Parkway and West Commercial Avenue at approximately 5:15 p.m., leaving an unidentified adult male civilian dead following an encounter with a New Jersey State Police trooper.

The Legal Mandate for Independent Review

This investigation is not discretionary; it is a direct requirement under New Jersey law. As noted by the Attorney General’s Office, the state operates under a 2019 statute, N.J.S.A. 52:17B-107(a)(2), which mandates that any death occurring during an encounter with a law enforcement officer acting in an official capacity must be investigated by the Attorney General. The law serves as a structural check on police power, requiring that findings from these investigations be presented to a grand jury. This process determines whether the evidence gathered supports a criminal indictment against the officer involved.

Establishing Accountability in Officer-Involved Shootings

For instance, the Okaloosa County Sheriff’s Office in Florida previously handled a high-profile case where an internal investigation determined that while a deputy’s use of force was not objectively reasonable—leading to his resignation—the incident did not reach the threshold for criminal charges after a review by the 1st Judicial Circuit State Attorney’s Office.

That Florida case involved Deputy Jesse Hernandez, who joined the agency in January 2022, and Sergeant Beth Roberts, an officer since May 2008. On November 12, 2023, near Fort Walton Beach, deputies responded to McLaren Circle at 8:42 a.m. regarding a vehicle honking its horn. A woman also reported that her boyfriend, Marquis Jackson, had committed grand theft auto and sent threats. She provided texts showing what looked like a firearm suppressor. Jackson was detained at 9:09 a.m. and placed in a patrol car. While Deputy Hernandez approached the car for a secondary search, he heard a “pop” sound he believed was a gunshot and yelled “shots fired” while rolling on the ground. Hernandez and Sergeant Roberts both fired into the vehicle. Body camera footage and witnesses confirmed the audible sound, which some thought was a muffled gunshot. Jackson was not injured and no weapon was found. Sergeant Roberts was exonerated, while Hernandez resigned on December 4 after a policy violation for excessive use of control to resistance was sustained.

In the New Jersey case, authorities have not yet released the name of the trooper or the deceased civilian, citing the ongoing nature of the inquiry. The question of what exactly transpired on Gotham Parkway on that Wednesday afternoon remains the central point of inquiry for investigators.

The Road Ahead for the Investigation

The transition from an initial scene response to a grand jury presentation is a process defined by evidence-based scrutiny.

The primary uncertainty remains the specific circumstances that led to the discharge of the trooper’s weapon. Until that time, the facts surrounding the encounter remain shielded by the ongoing investigation, leaving the ultimate question of criminal liability for the grand jury to resolve.
