Federal investigators uncovered evidence that Rep. Ilhan Omar entered into a sham marriage with a man believed to be her brother during a joint inquiry by the FBI and the Department of Homeland Security, though the matter ultimately stalled over statutory time limits, nypost.com reported. The 2016 investigation into the Minnesota Democrat’s marriage to Ahmed Nur Said Elmi focused on whether the arrangement was designed to secure legal status or student aid, intersecting with a broader federal look into immigration history.
The 2016 Probe and the Statute of Limitations Barrier
The existence of the 2016 inquiry came to light as the Justice Department pursues a wider examination of the congresswoman’s background. Omar wed Elmi on Feb. 12, 2009. Investigators eventually concluded that any potential charges for marriage fraud would have needed to be filed by 2014 to clear statutory thresholds. A source familiar with the closed probe told nypost.com that a Biden-appointed U.S. Attorney in Minnesota officially shut down the investigation shortly after taking office in 2021, noting that the timeframe had lapsed and the individual in question had moved overseas.
Throughout the years of public scrutiny surrounding her marital history, Omar has consistently maintained that allegations regarding the nature of her marriage to Elmi stem from a conspiracy theory. However, when pressed directly by anchor Chris Hayes during an interview, she answered, “Not to my knowledge.” State and federal records show that Omar’s divorce from Elmi was finalized in 2017, following a complex timeline of relationships that included an Islamic marriage to Ahmed Hirsi in 2002, a legal marriage to Hirsi in 2018, and her subsequent marriage to Tim Mynett in 2020.
Current Federal Focus on Citizenship and Document Records
The renewed federal scrutiny extends beyond the earlier marriage inquiry. Investigators are examining whether Omar committed fraud when she acquired U.S. citizenship in 2000 through her father, Nur Omar Mohamed, evaluating discrepancies regarding birth dates and her father’s legal status at the time. Records list her birth on October 4 in either 1981 or 1982. If the earlier year is correct, questions arise regarding whether she qualified for minor status benefits when her father was naturalized.
On Oct. 12, 2026, HSI agents raided the Washington home of Rep. Ilhan Omar under a court order. While criminal charges involving immigration statements face strict statutes of limitations ranging between five and ten years, civil denaturalization proceedings do not carry similar time restrictions. The Trump administration has pursued almost 200 civil denaturalization cases since the beginning of the president’s second term in January 2025.
